1 Agreement to Terms

By accessing or using KosClass ("the Platform", "we", "us", or "our"), available at kosclass.com, you agree to comply with and be bound by these Terms of Service and all applicable laws and regulations. These Terms apply to all users of the Platform, including teachers, students, parents, school administrators, and visitors.

If you are accepting these Terms on behalf of a school or organisation, you represent that you have the authority to bind that organisation to these Terms.

2 Eligibility & Age Requirements

KosClass is designed for use by teachers, school administrators, students, and parents. The following age requirements apply:

• Teachers and school administrators must be at least 18 years of age to create an account.
• Students under 13 may only use KosClass in a classroom setting under the supervision of a teacher, and only when the school or teacher has provided appropriate consent under applicable laws including COPPA (US) and GDPR (EU/UK).
• Students aged 13–17 may create accounts with parental or teacher consent as required by local law.
• Parents must be at least 18 years of age to create an account.

Students never need to create accounts to play games — they participate via the teacher's screen. Account creation for students is optional and subject to the above age requirements.

3 Your Account

When you create an account with KosClass, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, complete, and current information during registration
• Promptly update your account information if it changes
• Notify us immediately of any unauthorised use of your account
• Not share your account credentials with others
• Not create more than one account per person

KosClass reserves the right to suspend or terminate accounts that violate these Terms, contain false information, or are found to be used for prohibited purposes.

4 Usage License

KosClass grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial educational purposes, subject to these Terms.

Under this licence, you may not:

• Copy, modify, or distribute any part of the Platform without written permission
• Use the Platform for any commercial purpose without our prior written consent
• Attempt to decompile, reverse engineer, or extract source code from the Platform
• Remove any copyright or proprietary notices from the Platform
• Use automated tools, bots, or scrapers to access the Platform
• Resell or sublicence access to the Platform

This licence terminates automatically if you violate any of these restrictions.

5 User Content

KosClass allows teachers to create games, upload content, and share educational materials ("User Content"). By submitting User Content, you:

• Retain ownership of your content
• Grant KosClass a worldwide, royalty-free licence to host, display, and distribute your content for the purpose of operating the Platform
• Confirm that you own or have the necessary rights to the content you upload
• Confirm that your content does not violate any third-party rights or applicable laws

Content Standards

All User Content must be educational in nature and appropriate for the intended audience. Prohibited content includes but is not limited to: offensive, discriminatory, or harmful material; content that violates copyright; content that promotes illegal activity; and content that is inappropriate for children.

KosClass reserves the right to remove any User Content that violates these standards at any time without prior notice.

6 Prohibited Activities

You agree not to engage in any of the following while using KosClass:

• Impersonating another person, teacher, or organisation
• Harassing, bullying, or threatening other users
• Attempting to gain unauthorised access to any part of the Platform
• Introducing malware, viruses, or other harmful code
• Collecting personal information from other users without consent
• Using the Platform to send unsolicited communications (spam)
• Violating any applicable local, national, or international law
• Reproducing or sharing game content from the Platform in a way that competes with KosClass

Violations may result in immediate account suspension or termination and may be reported to relevant authorities.

7 Subscription & Billing

KosClass offers a Free plan and a Premium subscription plan. By subscribing to KosClass Premium, you agree to the following:

Recurring Billing

Your Premium subscription will automatically renew at the end of each billing period (monthly or yearly) unless cancelled before the renewal date. You will be charged in advance.

Payment Methods

We accept the following payment methods: credit and debit cards, PayPal, and cryptocurrency transfers (USDT, BTC, ETH, and SOL). For schools purchasing multiple teacher licences, we also accept bank transfers and can issue invoices. Contact billing@kosclass.com for school licence purchases.

Price Changes

KosClass may change subscription prices at any time. We will provide at least 30 days' notice before any price change takes effect. Continued use of the Platform after the price change constitutes your acceptance of the new price.

Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, your Premium access will remain active until the end of the current billing period. You will not receive a refund for the remaining period unless covered by our Refund Policy below.

8 Refund Policy

If you are not satisfied with KosClass Premium within the first 30 days of your subscription, contact us at billing@kosclass.com and we will issue a full refund with no questions asked. After 30 days, subscriptions are non-refundable except where required by applicable law.

If we terminate your account for a violation of these Terms, you are not entitled to a refund.

9 Children's Privacy & COPPA/GDPR Compliance

KosClass takes the protection of children's privacy extremely seriously. Our platform is designed so that students never need to create an account or provide personal information to participate in games — they join via the teacher's screen using a class code.

For students who do create accounts (optional), KosClass complies with:

• COPPA (Children's Online Privacy Protection Act) — for users in the United States
• GDPR (General Data Protection Regulation) — for users in the EU and UK
• Applicable national child privacy laws worldwide

KosClass does not knowingly collect personal information from children under 13 without verifiable parental consent or school consent where applicable. If we discover that we have inadvertently collected such information, we will delete it immediately.

Teachers and schools using KosClass are responsible for obtaining any necessary parental consent required by their local laws before allowing students to use the Platform.

KosClass does not display advertising to students and does not sell student data to any third party.

10 Intellectual Property

The KosClass name, logo, platform design, software, and all content created by KosClass are the exclusive intellectual property of KosClass and are protected by copyright, trademark, and other applicable laws.

You may not use the KosClass name, logo, or any of our proprietary content without prior written permission.

Copyright Infringement (DMCA)

If you believe that content on KosClass infringes your copyright, please send a written notice to legal@kosclass.com including: a description of the copyrighted work; the location of the infringing material on our Platform; your contact information; and a statement of good faith belief that the use is not authorised.

Repeat infringers will have their accounts suspended or terminated.

11 Disclaimer

KosClass is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure.

KosClass does not warrant the accuracy, completeness, or usefulness of any content on the Platform. User-generated games and content are created by teachers and third parties — KosClass does not verify or endorse such content.

12 Limitation of Liability

To the maximum extent permitted by applicable law, KosClass and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Platform, including but not limited to loss of data, loss of profits, or business interruption.

In no event shall KosClass's total liability to you exceed the amount you paid to KosClass in the 12 months preceding the claim.

13 Termination

KosClass reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any violation of these Terms or for any reason at our sole discretion.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

You may also delete your account at any time from your account settings. Deleted classes are kept in a recycle bin for 30 days before permanent deletion.

14 Governing Law

These Terms shall be governed by and construed in accordance with applicable international law. For users in the European Union, the laws of your country of residence may apply in addition to these Terms. For users in the United States, these Terms shall be governed by the laws of the State of Delaware.

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If that fails, disputes shall be resolved through binding arbitration, except where prohibited by local law.

15 Changes to These Terms

KosClass may update these Terms at any time. We will notify registered users of significant changes by email and will post the updated Terms on this page with a new "Last Updated" date.

Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Platform.
